Ute tribes’ Colorado lawsuit could set a precedent that goes beyond West Flagler

A pair of Colorado tribes are suing the state over the right to offer digital sports betting off reservation. The Southern Utes and Ute Mountain Utes argue that the West Flagler decision in Florida makes it so they have the right to offer statewide mobile betting under federal law. But does it?
The Southern Utes filed their lawsuit in July, about a week after the US Supreme Court declined to hear West Flagler vs Haaland. That case, decided in the US Circuit Court of Appeals for the District of Columbia Circuit, made it legal for the Florida Seminoles to offer statewide mobile betting.

The Ute Mountain Utes joined the Colorado lawsuit in September. The case is filed in the US District Court for the District of Colorado. And on Wednesday (16 October) the governor, Jared Polis, filed a motion to have the lawsuit dismissed.

SI Sportsbook’s Colorado exit another example of squeeze on the small guys

Colorado has long been the testing ground for small or alternative sports betting operators in the US. But SI Sportsbook is now the seventh platform in about a year to announce that it is exiting the state.
The last 12 to 18 months have seen more contraction than expansion in the wagering world. No US jurisdiction in 2024 has expanded gambling, whether that be sports betting or online casino. In November, Missouri voters could approve legal wagering. If they do, Missouri will be the only state this year to legalise. If they do not, 2024 will go down as the first year since the Professional and Amateur Sports Protection Act (PASPA) was overturned during which no US locales legalised.

Legislators from Georgia to Minnesota tried again in 2024 to legalise digital wagering, but ran into a variety of issues from moral objections to trying to tie legal wagering to other issues like video lottery terminals to managing charitable or tribal gaming.

Colorado wagering numbers up YoY, but handle down against June

Colorado's sportsbooks had a strong July, reporting increases in handle, revenue and taxes paid to the state against July 2023. Handle was up 14% and taxes paid to the state were up 33.2% according to the state's department of revenue.
The latest Colorado revenue report shows an 8.6% decrease in handle compared to June, but a 30.4% increase in taxes paid to the state. Digital wagering operators paid $2.4m (£$1.8m/€2.2m) to the state and bettors laid down $320.3m in handle.

The department of revenue uses the term “net sports betting proceeds” (NSBP) to identify operator revenue. For July, it was $25m, compared to $19.2m in June. Of that, the state’s online platforms accounted for $24.8m in NSBP and retail sportsbooks accounted for $175,009. Revenue was up from $19.1m in July 2023.

Colorado tribe invokes federal Florida decision in suing state for right to offer statewide digital sports betting

On Monday (8 July) Colorado's Southern Ute tribe revealed during an American Indian Affairs interim study committee meeting that it has sued Colorado's governor, Jared Polis, and the state of Colorado. The tribe claims that the state has blocked its ability to offer digital sports betting.

Tribal chairman Melvin J Baker invoked the recent decision by the US Supreme Court not to hear the West Flagler vs the US Deptartment of the Interior case as clearing the way for the lawsuit. Baker said that because that case “held that the Seminole tribe was entitled to engage in statewide sports betting in Florida any legal objection to the Southern Ute and Ute Mountain from engaging in statewide sports betting is gone.”

The tribe filed suit in the US District Court for the District of Colorado on Monday. The court set a 10 October date for a scheduling and planning conference. From there, if the parties have not reached an agreement, the case would move forward in court.

Suspected MGM hacker arrested in Spain

In 2022, MGM confirmed that its loyalty programme had been hacked. On 14 June, the Spanish national police arrested a man they believe to be involved in the hack at Palma Airport. He was boarding a flight to Italy, reported Murcia Today.

The FBI’s Los Angeles field office issued the arrest warrant for the 22-year-old UK national, per CyberNews.

The group responsible for the cyberattack, Scattered Spider, allegedly hacked multiple major corporations. The man arrested is accused of hacking corporate accounts and allegedly controlled $27m worth of BitCoin. Caesars Entertainment was also hacked last autumn.
