Brazil’s senate votes to approve sports betting – igaming removed

Brazil's senate plenary voted yesterday (12 December) to approve the amendments to Bill 3,626/2023, which will regulate sports betting. However, igaming was removed from the bill.

Originally scheduled for 6 December, the vote was delayed due to a lack of available senators to vote.

The bill was presented by Senator Angelo Coronel to the senate yesterday evening. It contained the latest round of amendments following initial approval of the bill three weeks ago by Brazil’s Economic Affairs’ Commission.

While the bill faced significant opposition, three key highlights were focused on in yesterday’s voting session.

The first, and most notable, is that the senate voted to remove igaming from the bill. The amendment was presented by Senator Carlos Portinho, with 37 votes in favour of excluding igaming and 27 against.

Brazil gambling regulation vote delayed to 12 December

Originally scheduled to take place at 2pm local time (5pm GMT) on 6 December, Brazil's senate vote has now been rescheduled until Tuesday 12 December.

Prospects are now bleak that it will be approved this year.

While the proposal of Brazil’s gambling regulation remained on the agenda, senators were unable to vote on the bill due to the lack of quorum.

As the minimum number of senators needed to vote was not met, it was not possible for the vote to go ahead as approval of the bill risks being compromised.

Factors behind the delay

When Brazil’s Economic Affairs Commission (CAE) approved Bill 3,626 two weeks ago, the industry thought the senate plenary vote would follow shortly after. But this has not been the case.

The senate plenary’s vote was scheduled for 29 November – but the vote was delayed until December after more than 100 amendments were added to the bill.

Brazil’s Senate plenary to delay final voting on regulation until December

Today's vote in Brazil's Senate plenary has been delayed until December, following more than 100 amendments to the bill.

Originally scheduled to vote for today (29 November), the Senate plenary has agreed to delay the vote until an unconfirmed date in December.

This follows the bill being presented by Senator Angelo Coronel, a key proponent for legalisation in Brazil.

The newly proposed amendments total more than 100, which will now be considered. These include a proposed taxation of fantasy sports on the same level as the 12% for sports betting and online casino, as well as the role of the health sector in the exclusion process.

Due to the requested amends, and there being a lack of of quorum to vote, the vote will now be delayed.

The president of the Brazilian Senate, Rodrigo Pacheco, will now need to decide the next voting date, although this is expected to be in December.

Australia lower house passes credit card gambling ban bill

The Australia House of Representatives, the lower house of the country’s parliament, has passed a bill that would introduce a blanket ban on using credit cards for online gambling.

The Interactive Gambling Amendment (Credit and Other Measures) Bill 2023 was submitted in September. It seeks to ban credit cards and other credit-related products, as well as digital currencies.

Introducing the bill has led to significant debate in parliament, with several amendments being filed to alter the bill. However, these were ultimately unsuccessful and the bill passed today (14 November) with support from both major parties in Australia.

The bill will now move forward to the Senate, the upper house of parliament in Australia, for further debate.

Kenya has introduce a Gambling Control Bill in an effort to establish a new Gambling Regulatory Authority.

The Gambling Control Bill 2023, currently before parliament, establishes a new Gambling Regulatory Authority. Once approved, it will replace the current Betting, Control and Licensing Board (BCLB).

Stake acquires Betfair Colombia

Cryptocurrency betting and gaming operator Stake.com has acquired Betfair Colombia, which sees the brand enter the market via the acquisition of Betfair's licence.

The licensing approval, granted by ColJuegos, the Colombia regulator, lasts until 2025.

Gambling Related Harm APPG launches white paper inquiry

The Gambling Related Harm All-Party Parliamentary Group (APPG) has launched an inquiry into the British government’s Gambling Act white paper review.

Published in April, the long-awaited white paper covered a range of major topics regarding gambling and future regulation in Great Britain.

The APPG-led inquiry, which launched today (14 June), will assess all proposed measures put forward in the white paper. The inquiry will also seek to hold the government to account and ensure reforms are taken forward quickly.

In addition, the inquiry will ensure where commitments have been made to legislate “when parliamentary time allows”, these are pursued as a priority. These include handing greater powers to the Gambling Commission to support enforcement.

Evidence deadline

The APPG will hold a series of oral evidence sessions as part of the inquiry and also accept evidence or submissions from interested parties. Any feedback must be submitted by 11 July.

Peru igaming regulations ban free bets, mandate supplier registration

Peru will ban free bets and demos, as well as mandating registration for suppliers, as part of its effort to regulate online gambling.

The detail comes as part of Peru’s efforts to regulate online betting and igaming. The country’s Congress unanimously voted for a bill to regulate the sectors in July, which was then signed into law in August, coming into effect 60 days later.

The law names the Ministry of Foreign Trade and Tourism of Peru (Mincetur) as the country’s official gambling regulator.

As regulator, the body established a number of rules that will apply to operators in the market, including a ban on free bets and supplier registration requirements.

These rules are subject to a consultation, with stakeholders able to submit their opinions until 2 December.

“No connection” between MGA and subjects of mafia investigation, regulator says

The Malta Gaming Authority (MGA) has said that recent preliminary investigations into mafia associations with Malta-based gambling have found no links between the MGA and suspected individuals.

Reports in the media said the Italian authorities had contacted the MGA regarding how the mafia had been using websites owned by Maltese operators to offer unlicensed and illegal gambling.

A report published in the Times of Malta last November said individuals illegally collected money for bets in Italy using sites belonging to Maltese companies operating without a licence issued by the Italian authorities. This, it claimed, helped them to launder money from other illegal activities.

A follow-up then said that preliminary investigations had concluded last week and that a total of 34 individuals had been identified.

Flutter CEO: Gambling Act white paper likely pushed back to 2023

Flutter chief executive Peter Jackson said that he thinks that the Gambling Act white paper is most likely to be delayed until next year, as he suspects new ministers will wish to “make their mark” on the document.

Speaking at Flutter’s Q3 earnings call, Jackson said he could not predict the the Gambling Act white paper timeline with any confidence, given that its release had repeatedly been pushed back by personnel changes in government and at the Gambling Commission. However, he said he would think its release was more likely to be in 2023 than this year.

“I don’t know if I can really comment on timing because I’ve tried to comment for the last two years and keep getting it wrong, so I might have lost some credibility there,” he said. “But I suspect it’ll end up coming out after Christmas as there isn’t much time now before Christmas.

“The new ministers I think will want to make their mark on it.”

The 2022 US midterm elections: What we are watching

As the US goes to the polls for the midterm elections, there are plenty of races that could affect the progress of sports betting regulation and gaming expansion. Paul Girvan picks out the states to watch.

The 2022 US midterm elections, while important in so many ways, contain few issues directly related to gambling regulation.

Rather, they represent an opportunity to extract a thorn that has irritated the body politic and coloured the consideration and adoption of more gaming legislation, whether it be sports betting legislation or casino regulation.
