Betting with benefits banned in Brazil pending final approval

Minister for Brazil's Federal Supreme Court Luis Fux has filed an injunction to ban betting via Brazil's Bolsa Familia social welfare cheque. The measure will be put to an emergency session of the Brazilian chamber of deputies today with plans to enforce it effective immediately.

The decision was made after a two-day hearing at the Federal Supreme Court (STF), initiated on Monday 12 November, sought to investigate the impacts of betting in Brazil and determine whether the law governing the upcoming legal market is constitutional.

The STF hearing was called following a request from Brazil’s third biggest trade union, the National Confederation of Trade in Goods, Services and Tourism (CNC), filed an ADI (Ação Direta de Inconstitucionalidade) which is a legal action in Brazil intended to overturn a law that conflicts with the country’s Constitution.

Brazil forms parliamentary betting commission to address gambling concerns

The parliamentary inquiry commission (CPI) on betting was formed in Brazil yesterday (12 November) ahead of the legal market launch on 1 January 2025, so senators can discuss their concerns with the industry.

The betting CPI was initially proposed on 8 October, with Senator Soraya Thronicke requesting its creation to investigate the “growing influence of online virtual gambling games on [Brazilian families’ financial spending]”.

Thronicke’s request received the 27 signatures needed but the group’s formation was delayed amid uncertainty over who would serve on the inquiry.

Thronicke was assigned the CPI’s lead, while Senator Dr Hiran Gonçalves will chair the commission with Senator Alessandro Vieira as vice chair.

The CPI will have 11 members and seven substitutes, with an initial 130 days in which to carry out its work and its next meeting will be next Tuesday (19 November), although Thronicke did not disclose the names of the first witnesses.

ANJL: Brazil black market will grow if betting law is deemed unconstitutional

The National Association of Games and Lotteries (ANJL) has said Brazil's black market activity would increase if the Supreme Court deems its betting law unconstitutional.

On Monday (11 November), the ANJL shared its thoughts at the ongoing Federal Supreme Court (STF) hearing which will determine whether Law No 14,790/2023 for legalised sports betting in Brazil is considered unconstitutional.

The two-day public hearing this week is investigating the impacts of betting in Brazil, with a number of big industry names speaking at the event. It was initiated after Brazil’s third biggest trade union, the National Confederation of Trade in Goods, Services and Tourism (CNC), requested the betting law be declared unconstitutional.

Former Brazil finance ministry advisor warns against banning online betting

José Francisco Manssur, former special secretary of the Brazil ministry of finance, has cautioned that a ban on online betting would be a backwards step for the country.

On 21 October, Senator Sérgio Petecão proposed Bill 4,031/2024 to ban online betting in Brazil over concerns it is driving fiscal debt and gambling addiction.

The bill is the latest in a string of initiatives by politicians to restrict online betting in Brazil, which is set to launch its legal market on 1 January 2025.

Manssur played a key role in Brazil passing its online betting legislation over the line, before he left his position as an advisor in February of this year, subsequently becoming a partner at law firm CSMV Advogados.

With 269 companies having so far applied for a betting licence ahead of the January launch, Manssur says there is clear evidence the industry supports the Secretariat of Prizes and Bets’ (SPA) regulations and deems them sufficient in protecting players.

Brazil bills call for spending caps among various vulnerable groups

Two new bills in Brazil aim to curb addiction and prevent gambling harms by limiting how much vulnerable groups can bet. These include the elderly and those receiving financial benefits. President Lula is expected to address these measures later this week.
Ahead of the licensed betting market’s launch on 1 January 2025, various government officials have raised concerns about the harmful social and fiscal impacts gambling could have on Brazilians.

PL 3,718/2024, presented by Senator Alessandro Vieira, and Congressman Elmar Nascimento’s PL 3,745/2024, both seek to limit how much various vulnerable members of society can gamble. Both bills were presented late last week on 26 and 27 of September.

PL 3,718/2024 would limit betting among the elderly, those registered in the active debt or credit protection registry and low-income families on the government’s CadÚnico social welfare programme.

NCPG says US states failing to meet online wagering safety standards

Connecticut, New Jersey, and Virginia lead, but still fall short of passing grade.
The National Council on Problem Gambling (NCPG) — a group that takes great pains to state its neutrality on the subject of gambling itself — Thursday (19 September) issued a report on the state of online responsible gambling. Specifically, the report addresses how states are managing player protection standards in the realm of online sports betting.

And if the findings were graded like a high school class, the states would be looking at some summer school.

Survey estimates 10% of Brazil population has suffered gambling-related financial issues

A survey by market research specialist Hibou has revealed 10% of the population in Brazil has endured financial problems from gambling ahead of regulation coming into force.
The survey, which included 2,839 respondents in Brazil from all social classes, studied the prevalence of gambling in the population.

The study found 68% of Brazilians gamble, with around 16% of respondents stating they had suffered from financial issues due to their gambling.

Is pre-regulation gambling causing social issues?
That equates to around 10% of the Brazilian population. While this may cause concern it is important to note it covers a period before the legal online market launches. The first legal bets will be placed on 1 January 2025, with 113 operators applying for a licence during the initial 90-day window of preference.

CFL wants Canadian parliament to spike gambling ad ban, as other countries ponder similar moves

Canada's parliament is considering a bill that would limit or potentially ban gambling ads. The commissioner of the Canadian Football League sent a letter to his country's parliament essentially telling it to butt out.

“We do not agree a national framework is required to regulate the advertising of sports betting in Canada,” CFL commissioner Randy Ambrosie wrote in a letter the senate’s standing committee on transport and communications.

“Having said that, we do not claim perfection on this or any other issue. We recognise in all we do we must remain open minded and continue to learn and evolve.”

Ambrosie may be the first major professional league commissioner anywhere in the world to publicly oppose a gambling ad ban. In the letter to the committee, Ambrosie outlined measures the league has already taken to limit exposure to gambling advertising. Mizuhara pleads guilty to stealing $17m from Ohtani to pay gambling debt

On Tuesday (4 June) morning, former Shohei Ohtani interpreter Ippei Mizuhara pled guilty to two federal counts of stealing $17m from Ohtani. Mizuhara fell hard and fast into gambling debt with an illegal bookmaker. His sentencing is set for 25 October.

Mizuhara, wearing a dark suit with an untucked shirt and no tie, told Judge John A Holcomb: “I worked for Victim A and had access to his accounts. I had fallen into major gambling debt. The only way I could think of to pay that was to send money from Victim A’s account” to the illegal bookmaker.

Mizuhara then pled guilty to one count of bank fraud and one count of subscribing to a fraudulent tax return. The maximum penalty for the charges is 33 years in prison and a $1.5m fine. Tuesday’s proceedings took place at the Ronald Reagan Federal Building and Court House in Santa Ana, California. Previous court appearances were at the Roybal federal complex in downtown Los Angeles.

What if Ippei Mizuhara had started betting with a legal operator in a legal market?

Shohei Ohtani's former interpreter Ippei Mizuhara bet millions with an illegal bookie. His addiction bloomed fast. Could he have been slowed or helped if he'd been wagering with a legal operator?

US operators have many checkpoints in place that may have indicated Mizuhara had or was developing an addiction problem. And none would have extended Mizuhara credit to gamble.

But the short answer, according to a recovering addict turned addiction counselor, is that none of that would have mattered. The best efforts by legal operators are no match for addiction.

“To a (addicted) bettor, none of those are a deterrent,” said Dave Yeager, who overcame a gambling addiction and is now a recovery counsellor. “In the throes of an addiction, when the addiction is at its highest, when the next bet is so all-consuming, then nothing else matters…. There’s just not a whole lot of things that are going to stop you from doing it.”

Denmark helpline StopSpillet receives nearly 3,000 calls in first five years

StopSpillet, the specialist gambling helpline run by Denmark regulator Spillemyndigheden, has received almost 3,000 calls since its inception in 2019.

StopSpillet was introduced on 1 January 2019, providing advice and guidance to those in Denmark who are concerned over their gambling habits.

A new report revealed that since its launch, StopSpillet has received 2,933 inquiries, with figures suggesting that a large percentage of those callers have a problematic relationship with gambling. Players calling for themselves were responsible for just over 1,650 inquiries, accounting for 56% of the total.

Additionally, 1,150 inquiries, or 40% of the total inquiries, came from relatives of players. In around half of those calls, it was a parent getting in contact with StopSpillet. Meanwhile, 4% of calls came from professionals.

France regulator ANJ notes “significant progress” in problem gambling prevention

L'Autorité Nationale des Jeux (ANJ), the gambling regulator in France, has noted “significant progress” in reducing problem gambling in its review of operators’ action plans.

Since a 2019 ordinance, all operators in France must submit an annual plan to prevent “excessive” and underage gambling. The ANJ then reviews those action plans. The aim is to increase dialogue between operators and the regulator on the issue.

The ANJ observed that the market has made palpable progress on preventing excessive gambling. Actions have been taken to raise awareness, such as messages to players and dashboards.

Protection standards for identification and support for problem gamblers has increased. The number of at-risk players identified and then supported has risen. The majority of operators implementing improved support measures and excluding players who have been identified as most vulnerable to commercial rewards has also gone up.
